1. Overview & Acceptance

AquaAtlas is owned and operated by Breachora LLC (“Breachora,” “we,” “us,” or “our”), a limited liability company organized under the laws of the Commonwealth of Pennsylvania.

By downloading, installing, accessing, or using the AquaAtlas mobile application and any related services (collectively, the “Service”), you (“User” or “you”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you must immediately discontinue use of the Service.

These Terms constitute a legally binding agreement between you and Breachora LLC. Your continued use of the Service constitutes ongoing acceptance of these Terms as they may be updated from time to time.

2. Eligibility & Account Registration

The Service is intended for users who are at least 13 years of age. By using the Service, you represent and warrant that you meet this minimum age requirement. The Service is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13.

You agree to provide accurate, current, and complete registration information and to maintain the confidentiality of your login credentials. You are solely responsible for all activity occurring under your account. Breachora LLC is not liable for any losses resulting from unauthorized use of your account. You must notify us immediately at support@aquaatlas.app if you suspect unauthorized access.

3. Nature of Service

AquaAtlas provides aquarium management tools, water parameter logging, livestock tracking, AI-powered analysis, flow planning, and optional subscription features. The Service is a decision-support tool intended for informational purposes only and does not replace professional aquatic, veterinary, or scientific consultation.

No information or output produced by the Service constitutes professional advice of any kind. Breachora LLC makes no representations that the Service is appropriate or available for use in any particular jurisdiction.

4. AI Limitations & No Veterinary Advice

AI-generated insights are probabilistic estimates based on user-provided inputs and trained models. Outputs may be incomplete, inaccurate, outdated, or unsuitable for your specific aquarium conditions. AquaAtlas does not provide licensed veterinary, medical, aquatic, or any other form of professional advice.

Users should consult qualified aquatic professionals, marine biologists, or licensed veterinarians for serious health, compatibility, treatment, or chemical dosing decisions. Reliance on AI-generated outputs is at your sole risk.

5. Subscriptions, Payments & Credits

Certain features require a paid subscription or the use of AI credits. Paid subscriptions are processed exclusively through the Apple App Store or Google Play Store. All billing, renewals, cancellations, and refunds are governed by the respective platform’s policies. AquaAtlas does not control and is not responsible for third-party payment processing systems.

AI credits allocated to your account are tied to your active subscription plan. Credits that are unused at the end of a billing period do not carry over unless expressly stated in your plan terms. Upon cancellation or expiration of a subscription, access to premium features will continue until the end of the paid billing period, after which your account will revert to the applicable free-tier limitations. Credits associated with a canceled or expired subscription are forfeited.

We reserve the right to modify subscription pricing, features, usage limits, or plan structures. Where required by applicable law, we will provide reasonable advance notice of material changes.

6. Acceptable Use

You agree not to: (a) misuse or abuse the Service; (b) attempt to reverse engineer, decompile, or disassemble the application; (c) circumvent subscription limitations or access controls; (d) automate, scrape, or exploit AI features beyond normal use; (e) upload or transmit malicious code, harmful content, or illegal material; (f) interfere with the performance, availability, or integrity of the Service; (g) attempt to gain unauthorized access to any portion of the Service or its underlying infrastructure; or (h) use the Service in violation of any applicable law or regulation.

Violation of these Terms may result in immediate account suspension, loss of subscription access and credits, and potential legal action.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BREACHORA LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND TITLE.

BREACHORA LLC DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. NO ORAL OR WRITTEN INFORMATION OBTAINED FROM BREACHORA LLC OR THROUGH THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BREACHORA LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LIVESTOCK LOSS, CORAL DEATH, DISEASE PROGRESSION, SYSTEM CRASHES, EQUIPMENT DAMAGE, FINANCIAL LOSS, LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY, AND EVEN IF BREACHORA LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL BREACHORA LLC’S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO BREACHORA LLC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) TEN DOLLARS (USD $10.00).

Use of AquaAtlas is entirely at your own risk. Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability, so the above limitations may not apply to you in full.

9. Indemnification

You agree to defend, indemnify, and hold harmless Breachora LLC and its officers, directors, employees, contractors, agents, licensors, and successors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of or access to the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content or data you submit, transmit, or make available through the Service.

10. Termination

Breachora LLC reserves the right to suspend or permanently terminate your access to the Service at its sole discretion, with or without notice, including for violations of these Terms, abuse of system resources, fraudulent activity, or inactivity. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall remain in effect.

11. Force Majeure

Breachora LLC shall not be liable for any delay or failure in performance of the Service resulting from events beyond its reasonable control, including but not limited to acts of God, natural disasters, power failures, internet outages, cyberattacks, government actions, pandemic conditions, or third-party service disruptions.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania and the United States, without regard to conflict-of-law principles. 13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

14. Entire Agreement & Waiver

These Terms, together with the Privacy Policy, Subscription Terms, Acceptable Use Policy, and any other policies referenced herein, constitute the entire agreement between you and Breachora LLC with respect to the Service and supersede all prior agreements, representations, warranties, and understandings.

No failure or delay by Breachora LLC in exercising any right under these Terms shall operate as a waiver of that right. Any waiver must be in writing to be effective.

15. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting the revised Terms to our website with an updated “Last Updated” date. Continued use of the Service following any changes constitutes your acceptance of the revised Terms.

Livestock Risk Disclosure

AquaAtlas provides aquarium management tools and AI-generated insights relating to livestock health, compatibility analysis, bio-load evaluation, stocking guidance, and water chemistry interpretation. These tools are informational and predictive in nature and do not guarantee biological outcomes.

Biological Variability

Aquarium livestock are living organisms subject to environmental, genetic, microbial, behavioral, and stress-related variables beyond the control of AquaAtlas or Breachora LLC.

Even when best practices are followed, livestock may experience illness, aggression, incompatibility, stress, disease progression, or mortality due to factors unique to each aquarium system.

Chemical & Dosing Risk

Adjustments to alkalinity, calcium, magnesium, nutrients, medications, supplements, or other chemical treatments carry inherent risk.

Improper dosing, rapid parameter fluctuations, inaccurate testing, equipment malfunction, or external contamination may result in livestock loss, coral damage, or system instability.

Users assume full responsibility for all chemical adjustments, treatments, or dosing decisions made based on application data, AI outputs, or recommendations.

Compatibility & Overstocking

AI-generated stocking and compatibility suggestions are derived from generalized behavioral models and bio-load calculations.

Individual temperament, territorial behavior, tank maturity, aquascape layout, feeding practices, maintenance schedules, and stress levels may produce outcomes that differ from model predictions.

Overstocking risks include oxygen depletion, nutrient spikes, aggression, disease spread, and catastrophic system failure.

Limitation of Liability

AquaAtlas is a decision-support tool and does not replace professional aquatic consultation or veterinary advice.

To the fullest extent permitted by law, Breachora LLC disclaims all liability for livestock death, coral loss, disease progression, tank crashes, equipment damage, financial loss, or any direct, indirect, incidental, consequential, special, or punitive damages arising from the use of the application or reliance on its outputs.

By using AquaAtlas, you acknowledge and accept the inherent risks associated with aquarium ownership and livestock care.


Diagnostic Accuracy & Image Analysis Limitations

Image-Based Analysis

AquaAtlas image diagnostics rely on user-submitted photographs and automated machine learning models trained on general aquatic datasets.

Results depend significantly on image clarity, lighting conditions, subject positioning, background interference, camera quality, and other environmental factors. Low-resolution, poorly lit, or obstructed images may materially reduce analysis accuracy.

Model Limitations

AI-generated predictions are probabilistic estimates derived from pattern recognition systems and statistical inference models. They are not definitive diagnoses.

The system may misidentify species, conditions, diseases, health indicators, or environmental stress factors, particularly in rare, emerging, visually similar, or incomplete data scenarios.

No Professional or Veterinary Guarantee

AquaAtlas does not provide licensed veterinary, medical, or professional aquatic diagnostic services.

Users must independently verify serious health concerns with qualified aquatic veterinarians, marine biologists, or other licensed professionals before administering treatment, altering water chemistry, or making livestock decisions.

User Responsibility

All aquarium care decisions remain solely the responsibility of the user.

To the fullest extent permitted by law, AquaAtlas and Breachora LLC disclaim all liability for livestock loss, treatment outcomes, system instability, equipment damage, financial loss, or consequential damages resulting from reliance on AI-generated image analysis.

Use of diagnostic features constitutes acknowledgment and acceptance of these limitations.
